Terms of Service

Welcome to Layovered. These Terms of Service ("Terms") govern your use of the Layovered mobile application, our website, and related services (together, the "Service"), provided by Layovered AI Systems Private Limited ("we," "us," or "our"). By creating an account, accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Layovered helps you plan and book international travel. Features include:

• Visa accessibility information — countries you may be able to visit based on your passport and any visas you hold.
• Visa-free flight search — flights that may be cheaper by routing through countries your passport can enter visa-free.
• Flight booking — you can book selected flights within the app; payment is processed through our payment gateway (see Section 5).
• Referral programme — invite others and earn additional routing searches (see Section 7).
• AI travel assistant — where available, an AI chat to help you use the app and answer travel questions.

2. Important Disclaimers — Please Read

• No guarantee of accuracy. Visa, flight and pricing information comes from third-party databases and automated processing. We do not guarantee its accuracy, completeness or timeliness.
• Visa information is guidance only. Visa rules change frequently and this is not legal advice. You are solely responsible for verifying all visa and entry requirements — for your destination and any layover country — with the official embassy, consulate or immigration authority before booking or travelling. Relying only on the app is at your own risk.
• AI assistant limitations. Where available, the AI assistant may produce inaccurate or outdated information; verify anything critical independently.

3. Eligibility

You must be at least 18 years old to create an account, make a booking, or use the Service.

4. User Accounts

You must register for an account and agree to provide accurate, current and complete information and to keep your credentials secure. You are responsible for activity under your account.

5. Bookings & Payments

When you book a flight through the app:

• Layovered facilitates the booking and collects payment through our payment gateway Razorpay. Your card/UPI/banking details are handled by Razorpay, not stored by us.
• The actual travel services (carriage by air) are provided by the airline via our supplier TBO, and are subject to their fare rules, conditions of carriage, and policies, which you agree to when you book.
• Prices and availability can change until a booking is confirmed. If a price or fare is shown in error, we may cancel the booking and refund any amount paid.
• A booking is confirmed only when you receive a confirmation from us or the supplier.
• The Service is currently provided without a Layovered service or convenience fee. We reserve the right to introduce such fees in future, and will disclose any fee before you pay.

6. Cancellations & Refunds

• Failed bookings. If your payment succeeds but the booking cannot be completed, we refund the amount you paid promptly, without you having to ask.
• Cancellations. You can cancel an eligible booking from within the app where the airline's fare rules allow it. Refunds for cancellations follow the airline's fare rules — where a fare is non-refundable, no refund is due. Airline cancellation charges, where they apply, are deducted from any refund.
• Layovered fees. Any service or convenience fee charged by Layovered (currently ₹0) is non-refundable once a booking is confirmed.

7. Referral Programme

• You may invite others using a share link. When someone you refer completes the qualifying action, both of you may receive a reward of additional routing searches.
• Rewards have no cash value, are non-transferable, and cannot be exchanged for money.
• We use device and attribution identifiers to validate referrals. We do not access your contacts.
• We may withhold or revoke rewards, and suspend accounts, for abuse — including self-referral, fake or duplicate accounts, same-device abuse, or any attempt to game the programme.
• We may change or end the programme at any time, with notice for material changes.

8. Third-Party Suppliers

The Service relies on third-party suppliers (airlines, aggregators, payment and analytics providers). Your booking is additionally subject to the relevant supplier's terms and privacy policy. We are not responsible for the acts or omissions of suppliers beyond our reasonable control, except as required by law.

9. Intellectual Property Rights

All rights, title and interest in and to the Service — including the app, its software, design, text, graphics, logos, and the underlying AI models — are and will remain the exclusive property of Layovered AI Systems Private Limited. You may not copy, modify, distribute or reverse-engineer any part of the Service without our written permission.

10. Acceptable Use

You agree not to misuse the Service, including: violating any law; interfering with or disrupting the Service; scraping or harvesting data; attempting unauthorised access; or abusing the referral programme (Section 7).

11. Limitation of Liability

To the maximum extent permitted by law, Layovered is not liable for indirect, incidental, special or consequential damages, or for loss arising from travel disruptions, denied boarding, visa refusals, supplier acts, or reliance on information provided by the Service. To the extent Layovered is found liable, its total aggregate liability for any claim will not exceed the amount you paid to Layovered for the booking giving rise to the claim. Nothing here limits liability that cannot be limited under law.

12. Indemnification

You agree to indemnify and hold harmless Layovered and its team from claims arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access for breach of these Terms, suspected fraud or referral abuse, or where required by law. You may stop using the Service and delete your account at any time.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction, subject to any consumer-protection rights you have under Indian law.

15. Changes to These Terms

We may update these Terms and will post the updated version with a new "Last Updated" date, notifying you of material changes. Continued use after changes means you accept them.
